Carepath Technologies is dedicated to protecting your personal information and informing you about how we use your personal information or any other information submitted by you on https://breathelabs.co and any other of our websites (“Website”), the BreatheLabs mobile app and software (“App”), via our any associated services offered such as digital processing services (“Services”) and through other means. This Privacy Policy applies to your use of the Website, App and Services, as defined within the BreatheLabs Terms of Service (“Terms of Service”). This Privacy Policy should be read in conjunction with the Terms of Service and is integrated into the Terms of Service. All capitalized proper nouns not defined in this Privacy Policy will have the same definitions and meanings as defined by the Terms of Service. Please review this Privacy Policy periodically as we may revise it from time to time. If you do not agree with or accept our Privacy Policy in its entirety, you must not access or use our Website, App and Services. If you use the Website, App and Services following a change to the terms of this Privacy Policy you agree to accept the revised policies. Carepath Technologies (“we”, “us”, “our”) means our entire company, including our United States affiliates, subsidiaries and related companies.
2. Collection of Personal Information
You can use our Website, App and Services without disclosing your personal data. You are not required to provide personal information, including personally identifiable information (“PII”) as a condition of using our Website, App and Services, except as may be necessary to provide you with information, products or services at your request. Personally identifiable information is information that can be used to identify you personally.
Personal Information Collected
In order to access or use some portions of the Website, App and Services, we may collect PII such as your name, email, address, phone number, age, gender, location, family information, health and breathing information, and information regarding your quality of life. We may also collect your relevant payment or credit card information if you wish to pay for any services offered via the Website, App and Services. Please be aware that all payment information shall be stored and processed by our third party payment processors. If you ask us to resolve complaints or concerns, we may require certain information necessary to fulfill your request (e.g., your name and contact information). If you choose not to provide any requested personal information, you may be unable to access certain areas of the Website, App and Services, such as password protected areas.
We may process behavioral analytical data, whether notifications are on or off, such as cough data, and any health data you have provided. This is to give you more accurate data to ensure that information is personalized for your experience and to collect anonymized data used for statistical purposes in order to improve the Website, App and Services. Data will be collected from the information you provide to us including when purchasing a Product (such as the BreatheLabs LungIQ™, BreatheLabs LungIQ™ Plus, BreatheLabs Gummies, BreatheLabs Gummies Kids) or cough data when such applicable Product is paired to the App. You are not required to provide the data if you do not want to, in which case you will not receive accurate information. You can change your preference at any time in your settings. You can also download and delete the non-anonymized data the Website and App has collected about you at any time in your settings. This will not include deletion of any anonymized data used for statistical purposes.
BreatheLabs Gummies and BreatheLabs Gummies Kids products are not intended to diagnose, treat, cure, or prevent any disease. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION OR TREATMENT PLAN OR PRIOR TO USING ANY DIETARY SUPPLEMENT.
Data will only be retained for as long as you wish (see “Accessing and Editing your Information” and Opt Out of Commercial, Non-Commercial Communications and Do Not Track” sections below) or as long as we believe is relevant to the business situation or service, whichever is the earlier; provided that, de-identified and/or anonymized data may be retained for development purposes to improve the Website, App and Services and for compliance purposes. Data will be collected from the information you provide to us when creating your profile through our Website and App. You are required to provide the data for the purpose of creating a profile and without that data, you will not get most out of the Website, App and Services and personalized insights.
Personal Information Collected Automatically
Whenever you use our Website and App, we may collect personal information from you, such as your IP address, registration history, interactions with the Website and App, usage information, location, referring URL, browser, operating system, data usage, data transferred, and Internet service provider.

We may process your contact information (including first name, last name, email address) when you subscribe to the Website, App and Services or provide such information on our Website, App and Services to resolve issues, or to provide answers to inquiries. 4. Legal Request
You agree that we may disclose your information to authorities if compelled to by a court order or a subpoena, lawsuit or legal inquiry, or in response to a law enforcement agency’s request. Additionally, you agree that we may disclose your information if we reasonably believe that you have violated US laws, the terms of our Terms of Service or our Privacy Policy, or if we believe that we or a third party are at risk of harm. In the event that we receive a subpoena affecting your privacy, we may elect to notify you to give you an opportunity to file a motion to quash the subpoena, or we may attempt to quash it ourselves, but we are not obligated to do either. 5. Accessing and Editing Your Information
You will be able to access any information contained in your account through our Website and App. You may edit that information by changing the information listed in your account. We may reject requests that are unreasonable or not required by law, including those that would be extremely impractical, could require disproportionate technical effort, or could expose us to operational risks. After you have deleted your account please be aware that we may keep inaccessible copies of your PII and non-PII subject to our data retention policies
6. Opt Out of Commercial, Non-Commercial Communications and Do Not Track
If you decide to provide us with your contact information, you agree that we may send you communications via emails. However, you may unsubscribe from certain communications by notifying Carepath Technologies that you no longer wish to receive these communications. We will endeavour to promptly remove you from our mailing list once we have received that request. We currently do not offer functionality for you to opt out through “do not track” listings. 7. Third Parties Websites
Carepath Technologies or other users may post links to third party websites on our Website and App, which may include information that we have no control over. When accessing a third party site through our Website and App, you acknowledge that you are aware that these third party websites are not screened for privacy or security issues by us, and you release us from any liability for the conduct of these third party websites.
Please be aware that this Privacy Policy, and any other policies in place, in addition to any amendments, does not create rights enforceable by third parties. Carepath Technologies bears no responsibility for the information collected or used by any advertiser or third party website. For example, when a browser visits a site, pixel tags enable us and these third parties to recognize certain cookies stored within the browser to learn which ads or other content bring a user to a given site. In addition, we may receive Other Information from these third parties, including through their service providers, such as advertising identifiers, IP addresses, and post-conversion data.

11. Do Not Track and Advertising Across Different Websites
We currently do not change our tracking practices in response to “do-not-track” signals or other similar mechanisms. Third parties that have content or services on our website such as a social feature, analytics service, or an advertising network partner, may obtain information about your browsing or usage habits. These third parties do not change their tracking practices in response to “do-not-track” signals from your web browser and we do not obligate these parties to honor “do-not-track” signals. We make reasonable attempts to protect your information by using physical and electronic safeguards such as encryption. However, as this is the Internet, we can make no guarantees as to the security or privacy of your information submitted. 13. Age Compliance
Children under the age of 13 are not the intended audience for the Website, App and Services. We do not collect or process any information for any persons under the age of 13. If you are under 13 and using our Website, App or Services, please stop immediately and do not submit any information to us. In the event that we have inadvertently collected any information from users under the age of 13 please contact us immediately.
14. International Transfer
Your information may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. PII and Non-PII that are submitted to Carepath Technologies will be collected, processed, stored, disclosed and disposed of in accordance with applicable United States’ law and this policy. In addition, such information may be stored on servers located outside your resident jurisdiction. United States’ law may not provide the degree of protection for information that is available in other countries.
15. Merger and Acquisition
In the event that Carepath Technologies is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. Please be aware that once the information is transferred your privacy rights may change.
16. Your California Privacy Rights
Carepath Technologies permits residents of the State of California to use its Website, App and Services and complies with the California Business and Professions Code §§ 22575-22579. We do not sell your personal information to third parties for money or other valuable consideration. We do not share your personal information with unrelated third parties other than as part of a contract where they provide a service to us for the business and commercial purposes described in this Privacy Policy.
